1. Overview

Welcome to Lamble.

In these Terms of Service, the terms “we”, “us” and “our” refer to Lamble. We operate this website and online store (the “Site”) and provide the products and services made available through it (together, the “Services”).

Our store is hosted on Shopify, which provides the e-commerce platform that allows us to sell our products to you. Any contract for the sale of products is between you and Lamble, not Shopify.

These Terms and Conditions (“Terms”) apply together with any policies referenced in them, including our Delivery and returns page, which forms part of these Terms and sets out important information about delivery, cancellations, returns and refunds.

Your use of the Site and Services is also subject to our Privacy Policy, which explains how we collect and use personal data.

Please read these Terms carefully before using the Site or placing an order. By accessing the Site, browsing, or making a purchase, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Site or Services.

Nothing in these Terms affects your statutory rights as a consumer under UK law.

2. Definitions

In these Terms:

“Consumer” means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
“Contract” means the legally binding agreement formed between you and Lamble when we accept your order.
“Order” means your request to purchase products through the Site.
“Products” means the goods offered for sale on the Site.
“Site” means our website and online store operated under the Lamble brand.
“Services” means the Site, the sale of Products, and any related customer services we provide.

3. Access and Accounts

You must be at least 18 years old to create an account or place an order on the Site.

You may browse the Site and place orders without creating an account. If you choose to create an account, you must provide accurate, current and complete information, and keep your details up to date so we can contact you about your orders.

You are responsible for maintaining the confidentiality of your account login details and for all activity that takes place under your account. You must not share your account or allow anyone else to use it.

Accounts are personal to you and may not be transferred, sold or assigned to another person.

We may suspend or close your account if we reasonably believe that there has been a breach of these Terms, misuse of the Site, or fraudulent or unlawful activity.

4. Products

We take reasonable care to ensure that product descriptions, images and prices displayed on the Site are accurate and up to date.

Product images are for illustrative purposes only. Colours and appearance may vary slightly depending on your device, screen settings, lighting conditions, or manufacturing processes.

All products are subject to availability. We reserve the right to limit quantities, refuse orders, or discontinue any product at any time.

Product descriptions and availability may be updated or changed from time to time. Any changes will not affect orders that have already been accepted.

5. Orders

By placing an order through the Site, you are making an offer to purchase products from us.

After placing an order, you will receive an automated email acknowledging receipt of your order. This email is for information only and does not mean that your order has been accepted.

Your order will be accepted, and a legally binding contract will be formed, when we confirm acceptance of your order. This usually occurs when payment has been processed and your order is prepared for dispatch.

All orders are subject to availability and acceptance by us. We may refuse or cancel an order where, for example, a product is unavailable, there is a pricing or description error, payment cannot be processed, or we reasonably suspect fraudulent or unlawful activity.

If we cancel an order before dispatch, we will refund any payment received in full.

6. Prices and Payment

All prices on the Site are shown in British Pounds Sterling (£) and include Value Added Tax (VAT) where applicable.

Delivery charges are not included in product prices and will be shown clearly at checkout before you place your order.

We reserve the right to change prices at any time, but any changes will not affect orders that have already been accepted.

If we discover an error in the price of a product you have ordered, we will contact you as soon as reasonably possible to give you the option to confirm your order at the correct price or cancel it and receive a full refund.

Payment must be made at the time you place your order using one of the payment methods available at checkout. By placing an order, you confirm that you are authorised to use the payment method provided and that sufficient funds or credit are available.

If payment cannot be processed or authorised, your order will not be accepted.

7. Shipping and Delivery

Details of our delivery options, costs and estimated delivery times are set out on our Delivery and returns page.

Delivery times are estimates only and begin from the date of dispatch. While we make reasonable efforts to deliver orders within the estimated timeframes, delays may occasionally occur due to factors outside our control, such as carrier delays, industrial action, or adverse weather conditions.

We remain responsible for your order until it is delivered to the delivery address you have provided. Risk of loss or damage passes to you when the goods are delivered to that address.

You are responsible for providing a complete and accurate delivery address. We are not responsible for delays or failed deliveries resulting from incorrect or incomplete address details provided by you.

Where tracking is available, we will provide tracking information once your order has been dispatched. We will notify you of any significant delivery issues where reasonably practicable.

8. Returns and Cancellations

That page forms part of these Terms and explains your statutory rights as a consumer, including your right to cancel an order within 14 days of delivery, as well as our process for returning unwanted, faulty or damaged items.

9. Intellectual Property

All content on the Site, including text, images, graphics, logos, designs, product descriptions and other materials, is owned by or licensed to Lamble and is protected by UK and international intellectual property laws.

You may use the Site and its content for your personal, non-commercial use only. You must not copy, reproduce, distribute, modify, create derivative works from, publicly display, publish or otherwise use any content from the Site without our prior written consent.

Nothing in these Terms grants you any licence or right to use any trade marks, logos or other intellectual property owned by Lamble or any third party, except as permitted by law.

The Lamble name, logo and branding are trade marks of Lamble. All other trade marks appearing on the Site are the property of their respective owners.

10. Use of the Website

You may use the Site for lawful purposes only and in accordance with these Terms.

You must not misuse the Site or attempt to interfere with its proper operation. This includes introducing viruses or other harmful material, attempting unauthorised access to the Site or its systems, or using automated means to extract data from the Site.

You must not use the Site for fraudulent purposes, to impersonate another person, or to purchase products for commercial resale without our prior written consent.

If you breach these Terms or misuse the Site, we may suspend or restrict your access to the Site or refuse to accept further orders from you.

11. Third-Party Services and Links

We use third-party service providers to help operate the Site and provide our services, including payment processing, delivery services and other technical tools.

When you use certain features of the Site or make a payment, you may be directed to or interact with services provided by third parties. Your use of those services is subject to the relevant third party’s own terms and policies, which you should review carefully.

We do not control and are not responsible for the content, performance or availability of third-party websites, tools or services that are linked to or integrated with the Site. Any links to third-party websites are provided for your convenience only, and accessing them is at your own risk.

12. Relationship with Shopify

Our Site is powered by Shopify, which provides the technical platform that enables us to sell our products to you.

Any purchases you make through the Site are made directly with Lamble. Shopify is not the seller of the products and is not responsible for any aspect of the sale, including the products themselves, delivery, returns or customer service.

Your contract for the purchase of products is between you and Lamble only.

13. Privacy Policy

We collect and process personal information in accordance with our Privacy Policy, which explains how and why we use your personal data and how we keep it secure. Our Privacy Policy forms part of these Terms and can be viewed here.

Our Site is hosted on Shopify, which provides the technical platform that enables us to sell our products. As a result, certain personal information may be processed by Shopify and other service providers acting on our behalf in order to provide and support the Services.

14. Feedback and Reviews

If you submit reviews, comments, feedback or other content relating to our products or services, you grant us a non-exclusive, royalty-free licence to use, display and share that content for the purposes of operating, improving and promoting our business, including on our Site and marketing channels.

By submitting feedback, you confirm that it is your own content or that you have the right to submit it, and that it does not infringe the rights of any third party or contain unlawful, offensive or misleading material.

We are not obliged to publish or respond to any feedback, and we may remove or moderate content where we reasonably consider it to be inappropriate, unlawful or in breach of these Terms.

We are not required to treat feedback as confidential or to provide compensation for it.

15. Errors, Inaccuracies and Omissions

While we aim to ensure that all information on the Site is accurate and up to date, occasional errors or omissions may occur, including in relation to product descriptions, pricing, promotions or availability.

We reserve the right to correct any errors or update information at any time. If an error affects an order you have placed, we will contact you as soon as reasonably possible to explain your options, including a refund where appropriate.

16. Promotional Codes and Offers

Promotional codes and offers are issued at our discretion and may be subject to specific terms and conditions, including expiry dates, usage limits, product exclusions and minimum spend requirements. Any applicable terms will be communicated at the time the promotion is offered.

Promotional codes must be entered at checkout and cannot be applied retrospectively to completed orders. Unless stated otherwise, promotional codes cannot be used in conjunction with other offers.

We reserve the right to withdraw, cancel or amend promotional offers where we reasonably believe there has been misuse, fraud or error.

17. Limitation of Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

Subject to this, we are responsible for foreseeable loss or damage caused by our breach of these Terms or failure to use reasonable care and skill. Loss or damage is foreseeable if it is an obvious consequence of our breach or was contemplated by you and us at the time the contract was formed.

We are not liable for losses, delays, or failure to perform our obligations where these are caused by events beyond our reasonable control.

This section does not affect your statutory rights as a consumer.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

If you are a consumer living in Scotland or Northern Ireland, these Terms will be governed by the laws of Scotland or Northern Ireland respectively, and you may bring proceedings in the courts of your country of residence.

If you are a consumer living elsewhere, you may bring proceedings in the courts of your country of residence where this is permitted by applicable law.

19. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on the Site and will apply from the date they are published.

Where required by law, we will notify you of material changes. Continued use of the Site after changes are published constitutes acceptance of the updated Terms.

20. General

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in full force and effect.

These Terms, together with the policies referred to within them, constitute the entire agreement between you and us in relation to your use of the Site and any purchases made through it.
